Terms of Use

1. Purpose

These Terms of Use set out the terms and conditions governing access to and use of the wargrounds-shop.com website (the “Site”), published by WARGROUNDS, a SAS with share capital of 15 000 euros, registered with the Grenoble Trade and Companies Register under number 994 302 438, whose registered office is at Zone d'Activités des Glairons, 7 rue Diderot, 38400 Saint-Martin-d'Hères, France. Any use of the Site implies full and unreserved acceptance of these Terms of Use.

2. Access to the site

The Site is freely accessible to any user with an internet connection. All costs required to access the Site (hardware, software, connection) are borne by the user. WARGROUNDS uses reasonable means to ensure the availability of the Site but cannot guarantee continuous, uninterrupted access. The Site may be temporarily unavailable for maintenance or updates, or in the event of force majeure.

3. Account creation and management

Certain features of the Site (placing an order, order tracking, customer area) require the creation of an account. The user undertakes to provide accurate, complete and up-to-date information, and to update it should it change. The user is solely responsible for the confidentiality of their login credentials and for all activity carried out from their account.

WARGROUNDS reserves the right to suspend or delete any account in the event of a breach of these Terms of Use, fraudulent use or unlawful conduct. The user may request the deletion of their account at any time by email to contact@wargrounds.fr.

4. Rules of use

The user undertakes to use the Site in accordance with the law, these Terms of Use and the customary practices of electronic communications. In particular, the user must not:

  • Interfere with the proper operation of the Site (attacks, intrusion, mass data scraping, denial of service).
  • Use the Site for fraudulent or unlawful purposes, or for purposes contrary to public order.
  • Copy, reproduce or exploit the contents of the Site without authorization.
  • Use a false name, a false address or unauthorized payment methods.
  • Infringe the rights of third parties (intellectual property, privacy, etc.).

5. Intellectual property

The Site as a whole (text, visuals, 3D models, photographs, logos, the WARGROUNDS trademark, source code, design, layout) is the exclusive property of WARGROUNDS or its partners and is protected by copyright, trademark law and design law. Any reproduction, representation, modification, exploitation or distribution, in whole or in part, without prior written authorization, is strictly prohibited and constitutes infringement (Articles L.335-2 et seq. of the French Intellectual Property Code).

6. Third-party trademarks

WARGROUNDS is an independent brand and is not affiliated with, sponsored by or endorsed by Games Workshop Ltd. Warhammer®, Warhammer 40,000®, Age of Sigmar®, Kill Team® and Citadel® are registered trademarks of Games Workshop Ltd, used solely for descriptive purposes to indicate the compatibility of WARGROUNDS products.

7. Liability

WARGROUNDS makes every effort to ensure the accuracy of the information published on the Site but cannot guarantee that it is complete or free of error. WARGROUNDS cannot be held liable for direct or indirect damages resulting from use of the Site, from a service interruption, from the presence of a virus or from intrusion by a third party, except in the case of gross negligence or willful misconduct on its part. The user acknowledges that they use the Site entirely at their own risk.

8. Personal data and cookies

The processing of personal data collected through the Site is described in our Privacy Policy. The use of cookies and trackers is governed in accordance with the requirements of the CNIL, the French data protection authority, and the GDPR.

9. Purchases on the Site

Any order for products placed on the Site is governed by our Terms and Conditions of Sale, which the user declares having read and accepted before confirming their order.

10. Amendments to these Terms of Use

WARGROUNDS reserves the right to amend these Terms of Use at any time in order to adapt them to changes in the Site, in regulations or in its practices. The applicable Terms of Use are those in force on the date the Site is used. It is the user's responsibility to consult the latest version in force regularly; it is accessible from the footer of the Site.

11. Governing law and jurisdiction

These Terms of Use are governed by French law. Failing an amicable resolution, any dispute relating to the interpretation or performance of these Terms will be submitted to the competent French courts having jurisdiction over the registered office of WARGROUNDS (Grenoble), subject to the mandatory procedural rules applicable to consumers.
