Terms and Conditions of Sale

1. Scope

These terms and conditions of sale (the “Terms”) govern all contractual relations between WarGrounds (the “Seller”) and any individual or legal entity making a purchase on the wargrounds-shop.com website (the “Customer”). They apply to the exclusion of all other terms. By placing an order, the Customer acknowledges having read these Terms and accepts them without reservation.

3. Products and descriptions

WarGrounds manufactures and sells premium bases and accessories for wargaming miniatures. The products are described on the site with the greatest care. However, slight variations in color or finish may occur from one batch to another because of the artisanal manufacturing process. Photographs and 3D renders are provided for illustration only and are not contractually binding.

Compatibility: our bases are third-party accessories compatible with standard wargaming sizes. They are neither produced nor endorsed by Games Workshop Ltd. Warhammer®, Warhammer 40,000®, Age of Sigmar®, Kill Team® and Citadel® are registered trademarks of Games Workshop Ltd.

4. Placing an order

The Customer places an order directly on the wargrounds-shop.com website by adding the desired products to the cart and then completing the checkout process. The order is definitively confirmed once payment has been confirmed. A confirmation email summarizing the items ordered, the total amount and the delivery details is sent to the email address provided by the Customer.

WarGrounds reserves the right to refuse or cancel any order in the event of a prior dispute with the Customer, suspected fraud or unavailable stock. If an item is unavailable, the Customer is informed as soon as possible and refunded if payment has already been taken.

5. Prices and payment

Prices are shown in euros (EUR), inclusive of all taxes. The applicable VAT rate is the one in force at the time of the order. Shipping costs are shown before final confirmation of the order and added to the total amount.

Payment is made online by credit card or digital wallet through our secure payment provider. The Customer warrants that they hold the authorizations required to use the payment method chosen. The order will only be processed once payment has been confirmed.

6. Delivery

Products are delivered to the address or pickup point specified by the Customer when ordering. The stated delivery time is 3 to 5 business days from confirmation of the order, in France as in the other countries served.

In mainland France, two delivery options are available, both operated by DPD France:

  • DPD Relais Pickup — collection at a pickup point: 5,99 €.
  • DPD Predict — home delivery with a time slot announced by SMS: 8,99 €.

Both options are free on orders over 80 €.

In Europe, delivery is handled by DPD and the rate depends on the destination country:

  • 11,99 € — Germany, Belgium, Luxembourg, Netherlands.
  • 14,99 € — Austria, Spain, Italy, Poland, Portugal, Czech Republic, United Kingdom, Switzerland.
  • 22,99 € — Croatia, Denmark, Estonia, Hungary, Ireland, Latvia, Lithuania, Slovakia, Slovenia, Sweden.
  • 24,99 € — Bulgaria, Finland, Greece, Norway, Romania.

Delivery within Europe is free on orders over 120 €. Shipping to the rest of the world costs 29 €. Transit times are given for guidance only. WarGrounds cannot be held liable for delays attributable to the carrier.

The risks associated with transport are borne by the Customer from the moment the products are handed over to the carrier. If damage is observed on delivery, the Customer must record reservations with the carrier and inform WarGrounds within 48 hours.

For deliveries outside the European Union, any customs duties and local taxes remain payable by the recipient.

7. Right of withdrawal

In accordance with Articles L221-18 et seq. of the French Consumer Code, the Customer has 14 days from receipt of the products to exercise their right of withdrawal, without having to give a reason or pay a penalty.

To exercise this right, the Customer must notify their decision by email to contact@wargrounds.fr. Products must be returned in their original packaging, in perfect condition, to the address indicated by the Seller. Return shipping costs are borne by the Customer. The refund is issued within 14 days of receipt of the returned products, using the same payment method as the one used for the order.

Exceptions: the right of withdrawal does not apply to products personalized or made to order at the Customer's request (Article L221-28 of the French Consumer Code).

8. Warranties

Statutory warranty of conformity (Articles L217-4 et seq. of the French Consumer Code):

WarGrounds warrants that the products conform to the contract and are free from defects of conformity. In the event of non-conformity, the Customer may choose between repair or replacement of the product. If both of these remedies are impossible or disproportionate, the Customer may obtain a price reduction or rescission of the contract.

Statutory warranty against hidden defects (Articles 1641 et seq. of the French Civil Code):

WarGrounds warrants the Customer against hidden defects in the item sold that render it unfit for its intended use, or that so impair that use that the Customer would not have bought it, or would have paid a lower price for it, had they known of them. This warranty runs for two years from the discovery of the defect.

9. Liability

WarGrounds cannot be held liable for indirect damages, loss of business, loss of profit or loss of opportunity resulting from the purchase or use of the products. The liability of WarGrounds, in the event of proven direct damage, is limited to the total amount of the order concerned. WarGrounds cannot be held liable for the incompatibility of the products with miniatures or third-party game systems not listed as compatible on the site.

10. Intellectual property

All elements of the wargrounds-shop.com website (text, images, photographs, logos, design, code) are the exclusive property of WarGrounds or its partners and are protected by copyright and trademark law. Any unauthorized reproduction, representation, modification or exploitation is strictly prohibited.

11. Personal data

Personal data collected in connection with orders is processed in accordance with our Privacy Policy. The Customer has the right to access, rectify and delete their data by contacting contact@wargrounds.fr.

12. Governing law and dispute resolution

These Terms are governed by French law. In the event of a dispute, an amicable solution will be sought first, in writing, at contact@wargrounds.fr. Failing an amicable agreement within 60 days, the dispute will be brought before the courts having jurisdiction over the registered office of WARGROUNDS (Grenoble).

In accordance with Articles L612-1 et seq. of the French Consumer Code, every consumer has the right to use a consumer ombudsman free of charge with a view to the amicable resolution of a dispute.

The registration of WARGROUNDS with an approved consumer ombudsman is in progress. The full details of the appointed ombudsman (name, postal address and website) will be published on this page and in our legal notice as soon as the process is complete. In the meantime, any complaint may be sent to contact@wargrounds.fr: we undertake to respond within 24 business hours and to seek an amicable solution.

Consumers may also use the European Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr.

13. Amendments to these Terms

WarGrounds reserves the right to amend these Terms at any time. The applicable terms are those in force at the time the order is placed. Amendments take effect as soon as they are published online and do not apply to orders confirmed beforehand.
